2. Scope of Service

Latency Watch is an online service for the automated monitoring of websites. The service checks the availability, HTTP status, and response times of URLs at configurable intervals and sends email notifications when issues are detected.


3. Contract Formation and Registration

3.1 Use of the service requires registration. To register, the user provides their email address. The contract is formed when the user enters their email address and clicks the login link sent by email.

3.2 Only a valid email address is required for registration. No additional personal data is necessary.

3.3 The user is obliged to keep their email address up to date and to ensure that emails from latency.watch can be received.

3.4 There is no entitlement to registration. We reserve the right to decline registrations without stating reasons.


4. Plans and Scope of Services

4.1 The service is offered in various plans (FREE, PLUS, PRO). The current scope of services and prices are available at: https://app.latency.watch/plans/

4.2 The FREE plan is free of charge and limited to 2 monitors with a check interval of at least 30 minutes.

4.3 The specified check intervals are indicative. Minor deviations are technically possible and do not constitute a defect.

4.4 All prices are gross prices inclusive of applicable VAT. The actual VAT rate depends on the user's country of residence and is calculated by Paddle.


5. Payment and Subscription

5.1 Paid plans are billed monthly in advance through Paddle.com Market Limited ("Paddle"), acting as Merchant of Record. Paddle is the contracting party for the purchase and is responsible for payment processing, invoicing, and tax remittance.

5.2 Subscriptions renew automatically for another month unless cancelled before the end of the current billing period.

5.3 There is no minimum term. Cancellation is possible at any time via the Paddle customer portal in the account settings. After cancellation, access remains available until the end of the paid period.

5.4 When upgrading to a higher plan, the difference is charged immediately on a pro-rated basis for the remaining days of the billing period.

5.5 When downgrading to a lower plan, the new plan takes effect at the start of the next billing period. No partial refund is issued for the current period.


6. Monitor Limits and Downgrade

6.1 Each plan defines a maximum number of monitors. When downgrading to a plan with a lower monitor limit, excess monitors are automatically paused (starting with the most recently created). Collected data is retained.

6.2 The user is informed before a downgrade about monitors that will be automatically paused. It is the user's responsibility to delete paused monitors or upgrade to a higher plan.


7. Availability

7.1 The service is provided "as is", without warranty of fitness for a particular purpose, freedom from errors, or uninterrupted availability. Maintenance work, technical issues, or failures at the hosting provider may cause temporary interruptions.

7.2 The service is intended to notify users about website status. We accept no liability for missed notifications, delayed checks, or any resulting damages, to the extent permitted by law.


8. Intellectual Property

The content of the service — including texts, structures, and the appearance of the website — is protected by copyright. Reproduction, distribution, or public disclosure without express permission is not permitted.


9. User Obligations

9.1 The user may only use the service for lawful purposes. In particular, the following are prohibited:

  • Monitoring URLs for which no authorization exists
  • Using the service to conduct attacks against third parties
  • Sending automated mass requests outside of the intended use
  • Reselling or commercially providing the service to third parties

9.2 In the event of a violation of these obligations, we reserve the right to suspend or delete the account immediately.


10. Account Deletion

10.1 The user may delete their account at any time at https://app.latency.watch/account/. Upon deletion, all data (monitors, check results, email address) is permanently removed.

10.2 Account deletion is only possible after an existing subscription has been cancelled and the paid period has expired.


11. Right of Withdrawal

11.1 Consumers have a statutory right of withdrawal. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their commercial or independent professional activity.

11.2 Withdrawal notice: You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the date of contract formation.

by means of a clear statement (e.g. an email) of your decision to withdraw from this contract. To meet the withdrawal deadline, it is sufficient that you send the notification before the withdrawal period expires.

11.3 Consequences of withdrawal: If you withdraw from this contract, we will repay all payments received from you promptly and no later than fourteen days from the day on which we received notification of your withdrawal. We will use the same means of payment you used for the original transaction, unless expressly agreed otherwise.

If you requested that services begin during the withdrawal period, you shall pay us a reasonable amount corresponding to the proportion of services already provided up to the point at which you notified us of your withdrawal, compared to the total scope of services provided under the contract.


12. Liability

12.1 We are fully liable for damages resulting from injury to life, body, or health, as well as for intentional or grossly negligent breaches of duty.

12.2 In cases of slightly negligent breach of material contractual obligations (cardinal obligations), liability is limited to the typically foreseeable damage.

12.3 Any further liability for slight negligence is excluded.

12.4 The above limitations of liability do not apply to the extent that mandatory product liability law is applicable.


13. Changes to the Service and Terms

13.1 We reserve the right to adjust or extend the scope of the service at any time.

13.2 Changes to these Terms of Service will be announced to registered users by email with at least 30 days' notice prior to taking effect. Users with a paid subscription must explicitly consent to changes. Users of the free FREE plan may object to changes; if no objection is raised within the stated period, the changes are deemed accepted. The right to object will be explicitly stated in the announcement.

13.3 In the event of an objection or refused consent, we are entitled to terminate the contractual relationship as of the date the changes take effect.


14. Governing Law and Jurisdiction

14.1 The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

14.2 If the user is a consumer residing in the European Union, the mandatory consumer protection provisions of their country of residence also apply.

14.3 The place of jurisdiction for disputes with users who are merchants, legal entities under public law, or public-law special funds is Karlsruhe.


15. Dispute Resolution

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
